Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and BataNayaar ("we", "us", the "Service"). By accessing or using the Service in any way, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.

1. Eligibility (strictly 18+)

The Service is intended only for adults aged 18 years or older. By using BataNayaar, you represent and warrant that you are at least 18. We do not knowingly permit minors to use the Service, and we may terminate access where we believe a user is under 18.

2. What the Service is

BataNayaar provides anonymous, real-time text chat with random strangers or with an AI chat companion. We do not store chat content — messages are relayed in memory and discarded when the chat ends. The Service is for casual conversation only. It is not a dating, matchmaking, counselling, medical, legal, or emergency service, and must not be relied upon as such.

3. AI disclosure

You may be matched with an AI chat companion instead of a human. AI conversations are clearly labelled with an "AI" badge. The AI is a software program, not a real person, its responses are automatically generated, and they may be inaccurate or inappropriate. We never present the AI as a human, and you must not rely on anything the AI says.

4. Your responsibility for your conduct

You are solely responsible for everything you say and do on the Service and for any information you choose to share with another user. You agree not to:

  • harass, threaten, abuse, stalk, defame, or impersonate anyone;
  • share hate speech, sexual content involving minors, or any unlawful content;
  • share another person's private or personal information;
  • send spam, scams, malware, or solicit money or personal data; or
  • use the Service for any illegal purpose or in violation of any law.

Violations may result in an immediate and permanent ban without notice or refund. You should never share sensitive personal, financial, or identifying information with strangers.

5. No guaranteed match or availability

Matches (human or AI) depend on availability. We do not guarantee a human match, a match of any particular gender or language, uninterrupted access, or that the Service will be error- free or available at any given time.

6. Payments

A Pro session costs ₹50 and grants a single 30-minute session with the ability to choose your match preference. One purchase equals one session; a separate purchase is required for each additional session. Payments are processed by our payment provider (Razorpay) and are subject to our Refund & Cancellation Policy.

7. Limits of anonymity

We do not store chat content. However, payment processing requires details (such as your phone number, UPI ID, or card information) that are collected and handled by Razorpay under their own terms and privacy policy. 8. Service provided "as is"

The Service is provided on an "as is" and "as available" basis, without warranties or guarantees of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will meet your expectations or be safe, secure, or error-free.

9. Limitation of liability — we are not liable

To the maximum extent permitted by law, BataNayaar is not responsible or liable for anything that happens through or in connection with the Service. In particular, and without limitation, we are not liable for:

  • the conduct, statements, messages, or behaviour of any other user, whether online or offline, including anything offensive, harmful, false, or illegal;
  • any content exchanged in a chat, including anything generated by the AI companion;
  • any decision you make, or action you take, based on a conversation on the Service;
  • any contact, meeting, relationship, loss, harm, injury, or damage arising between users;
  • any interruption, downtime, data loss, bug, or unavailability of the Service; or
  • any indirect, incidental, special, consequential, punitive, or exemplary damages.

You use the Service entirely at your own risk. Where liability cannot be excluded by law, our total aggregate liability to you for any claim is limited to the amount you actually paid us (if any) in the 30 days before the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold harmless BataNayaar from any claims, losses, liabilities, or expenses arising out of your use of the Service, your content, or your breach of these Terms.

11. Termination & bans

We may suspend, restrict, or terminate your access at any time, including following reports of abuse, with or without notice, and without any liability to you.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Service after changes means you accept the updated Terms.

13. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at our place of operation in India will have exclusive jurisdiction over any dispute. Any complaint or grievance must first be raised through our contact form.
